Terms of Service

1. Acceptance of Terms

By accessing and using DigiPlot, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, please do not use our service.

2. Service Description

DigiPlot provides an AI-powered plot digitization service that converts scientific charts and graphs into machine-readable data formats (currently CSV). The service is provided on a credit-based system with free and paid tiers.

3. User Account

To access certain features, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

4. Pricing and Credits

4.1 Free Tier

Anonymous usage is limited to 3 plot extractions per day (UTC day). Anonymous usage is identified through request/session signals used for abuse prevention and quota enforcement.

4.2 Paid Credit Packages

Signed-in users access the service through credits. Credit packages, pricing, and available product options are shown on the pricing page and at checkout.

Unless explicitly stated otherwise at purchase time, each finalized plot extraction consumes 1 credit. Purchased credits currently do not expire, but we may change future credit policies prospectively.

4.3 Payment Processing

All payments are processed securely through Stripe. We accept major credit cards. By purchasing credits, you agree to provide accurate payment information and authorize us to charge your payment method for the selected package.

5. Acceptable Use

You agree not to:

• Use the service for any illegal purpose
• Upload malicious content or malware
• Attempt to circumvent rate limits or security measures
• Reverse engineer or copy our AI models
• Resell or redistribute our service without permission
• Upload content that infringes third-party rights or violates applicable law

6. User Content and Permissions

You retain ownership of the files and content you upload. You grant DigiPlot a limited, non-exclusive license to host, process, transform, and transmit that content solely as needed to provide and secure the service.

You are responsible for ensuring you have all rights, permissions, and legal authority needed to upload and process your content through DigiPlot.

7. Refund Policy

Due to the digital nature of our service and immediate credit delivery upon successful payment, all credit purchases are final and non-refundable. However, we may issue refunds at our sole discretion in cases of:

• Technical errors preventing service delivery
• Duplicate charges
• Unauthorized transactions

To request a refund, contact us at [email protected] within 14 days of purchase. Refund requests are reviewed on a case-by-case basis.

8. Intellectual Property

You retain all rights to the images you upload. The extracted data generated by our service belongs to you. DigiPlot retains all rights to our software, AI models, and service infrastructure.

9. Disclaimer of Warranties

DigiPlot is provided "as is" without warranties of any kind. We do not guarantee that the service will be uninterrupted, secure, or error-free. The accuracy of extracted data may vary depending on input quality.

You are responsible for reviewing and validating all outputs before relying on them for research, engineering, regulatory, clinical, financial, legal, or other high-risk decisions.

10. Limitation of Liability

DigiPlot shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the service.

To the maximum extent permitted by law, DigiPlot's total aggregate liability for all claims related to the service will not exceed the greater of (a) the amount you paid to DigiPlot in the 12 months before the event giving rise to the claim, or (b) USD $100.

11. Indemnification

You agree to defend, indemnify, and hold harmless DigiPlot and its founders, officers, employees, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your content, your use of the service, or your violation of these Terms or applicable law.

12. Termination

We reserve the right to terminate or suspend your account at any time for violations of these terms or for any other reason at our discretion. Upon termination, any unused credits will be forfeited without refund, except as required by applicable law.

13. Governing Law and Venue

These Terms are governed by the laws of the jurisdiction where DigiPlot is established, without regard to conflict-of-law rules. You agree that any dispute not subject to mandatory arbitration requirements under applicable law will be brought exclusively in the competent courts of that jurisdiction.

14. Changes to Terms

We may modify these terms at any time. Continued use of the service after changes constitutes acceptance of the new terms.
